I think it's necessary in these circumstances to make sure that you make your target audience aware of where they can receive your programmes.
Legal and/or other issues between the companies is really irrelevant when you are trying to promote the availability of your product. Most of the public will accept "Sky" as meaning DSat, "Freeview" as meaning DTT, and (very slowly) "Virgin" as meaning DCab.
However, if you simply advertise as Satellite Channel XXX you are likely to make a small proportion of your target believe that it is not available through Sky.
