Point of order: what does the ITC define as "subliminal"? That is to say, does a one-frame flash count? A five-frame flash? What is the minimum duration to

They don't specifically define it, they just refer to "very brief duration" being unacceptable.

Thank you indeed, Nick. I would imagine (as per the last post) if some people can percieve the short picture, and others cannot, then it does indeed violate the statute, as people apparently must be fully aware of what they're being shown. I would imagine if this was brought to the ITC's attention that it would not be approved for broadcast again.
It's an interesting point, though --- if the person reviewing the advert for broadcast can't see the allegedly subliminal image, then how can he or she determine if the advert is unacceptable? Does the ITC need to review all adverts in slow motion or something?
