Carlton and Granada have the right to use the ITV brand in connection with the ITV network, just as every other franchise holder does, but they do not have an implied right to start applying it to all of their non ITV network ventures (which include ITV2 and the ITV News Channel), and they certainly do not have an implied right to name a merged company ITV PLC and thus effectively walk away with the brand just because they hold the majority of the ITV network franchises. The only acceptable situation in which 'ITV' becomes an actual company rather than a concept is if ALL franchise holders are part of the same company. And even though the Carlton/Granada merger is touted as creating a 'single company ITV' it infact won't, it will just create a new more powerful ITV company, but there still will be other ITV franchise holders which are not part of thier merged company. SMG is therefore arguing on these grounds that Carlton and Granada have no right to call their company ITV PLC.

And I'm inclined to agree with them.
