A Question regarding Copyright

with regards to Only Fools and Horses (January 2005)

Yes, what the BBC did is changed the theme tune because the great unwashed public did not understand the name "Only Fools and Horses".

Oh sorry.

I was just wondering if I could find another way to say the same thing ... AGAIN.

How many times has it been repeated in this thread now??

Also intresting to note, on the subject of copyright that one episode "The Jolly Boy's Outing" had to be edited before it could be sold on VHS/DVD as to remove one of the songs in the club, this has not been removed (as far as my knowledge) in the broadcast version, as IIRC the BBC have permission to broadcast the music, but not to sell it on VHS/DVD.

Yes, that happens to many DVD/CD/tape/Video releases. On TV or radio the music comes under the broadcasters PRS arrangements. However this is only for public perfromance or broadcasting so the music needs to be seperately cleared for use when the programme is released for sale. Although this is normally perfectly possible it often costs far to much to be worth doing it.

Notable examples are Fawlty Towers where the music that comes blaring out of Mrs Richards radio is diffrent on the record/video version and the cassette/CD releases of I'm Sorry I Haven't a Clue have a diffrent arrangement of the theme tune.

A very good place to look at is the 'Edit news' section of 'Some of the Corpses Are Amusing':

Alot of the Only Fools and Horses DVD's are edited for 'Contractual reasons', as 'To Hull and Back' is edited, but I've never noticed the edit.

One DVD that has been edited is Trigger Happy TV and listen to the Commentary by Dom Joly on the best of Series 2 and he explains that some of the music you hear on the show on TV is not the same on the DVD, even though the programme has an accompanying soundtrack to it. He also said that they asked one artist for their song, he didn't know what THTV was, so they sent him a copy and he didn't like the programme at all and the song was refused to be shown on it!

Episode 3 of Series 1 of Phoenix Nights is also edited for the same reason, the music when the women are doing Aerobics is different, also that on the DVD it has the huge apology to Mr Keith Laird where as the TV version doesn't. (Same with Episode 2 of That Peter Kay Thing)

Yes, that is contractual. The character was so similar in many respects to a fire safety officer called Keith Laird that Channel 4 either had to stop showing the programme or come to his terms - a charity donation an apology and some fire safety promotion. www.channel4.com/firesafety has to remain on their site for as long as the programme and DVDs are avaliable

Also, the DVD version of "Time on our hands" has a different version ofthe song (not sure what it's called,I'll just call it "our house") when it shows Del & Rodney in their new homes. The version shown on TV has a malevocal, the DVD has a female one.

I've got an old Fawlty Towers VHS from 1984. The layout of it is quite bad. They have 1 opening and all episodes are joined together. Also, at the end of the video, the credits from every programme are shown. Sorry, I'm going a bit off-topic Laughing .

Yes I have this same video! All the episodes are joined by what is literally a scene changeover, and that's it, as if it were part of the same episode. They then play the end credits at the end with a montage of all the characters from those 3 shows, and a badly looped version of the theme.

The TV version is the original by Crosby, Stills, Nash & Young. No idea who the female vocalist is - probably some obscure artist who's much easier to clear than CSN&Y!

This was standard practice in the early years of BBC home video releases. Doctor Who, Blake's 7, The Young Ones and many other programmes that had multiple episodes released on one tape were edited into movie-length compilations, because it was felt that consumers didn't want to sit through opening and closing credits for each individual episode.

They also sometimes cut out scenes to keep running times short. ISTR that some very early Doctor Who releases were actually cut down from approx. 90 minutes to 60!

The BBC used to be in an interesting situation as regards using music and their rights over it. ISTR that the BBC in some ways exists outside the realms of the MCPS or PRS... for broadcast purposes, but not for commercial exploitation.

Therefore quite often there will be one version broadcast and another MCPS/PRS friendly version released on VHS/DVD/CD etc...

Of course this point is irrelevant for the first series of OFAH - as has been said, the versions people have heard with the familiar theme and Hookey Street have been prepared so as not to confuse your average Joe.

Trouble is both the original versions and the modified versions have been broadcast, and it would appear that both versions have also been released on video.

As a side note, the versions released on the recent "DVD collection" magazine, are the modified versions...

Oh what a tangled web... as ever!

While the initial apology was warranted, surely doing it every time just increases the embarasment to Mr Laird.

So on things like Blake's 7 and Doctor Who were the end credits altered for all the extra people? On Fawlty Towers the credits aren't really important, but on things like Doctor Who and Blake's 7, in other words science fiction the credits are part of the show so to speak. So if they put in a generic set of credits people would be annoyed, especially the fans! The same with the theme tune. Surely they'd have to extend the theme tune to fit all the credits in?
