Ofcom v Competition Commission

The decision by News corp to withdraw it's bid for the 61% shareholding in BskyB got me thinking. If the Competition commission ruled the takeover was ok, but Ofcom then ruled that News corp wasn't a fit and proper owner, and refused them the license, which decision over-rides the other?

If the News Corp takeover was going to result in Ofcom revoking BSkyB's license, the competition commission would have no control over this, so the takeover would probably not go ahead (unless they successfully appealed against it).

If Ofcom decided against News Corp being suitable, then they could still buy BSkyB, however BSkyB would be unable to broadcast, therefore leaving the company rather useless.

Yep. I think that both bodies have to be happy for the bid to succeed. If either of them decide there is a problem then it stops.

Unless they chose to purchase the platform and sell-off the channels?
