The C3 franchisees took a risk, as any business does, and agreed to a contract to pay money in return for their expected revenues and guaranteed perks. They've already had so much contractual slack applied to their PSB commitments in England that it would be hard to enforce anything on the basis of 'custom and practice'.
Having let the franchisees off the disadvantages of being a PSB, but still allowed them the benefits of grifted DTT spectrum and favoured reserved EPG positions, Ofcom have relented on the final bastion of state reward for this by GIVING it all away for virtually nothing!
It's time to remove the licences from C3 and sell its DTT spectrum for its true market value.
