If a company surrenders it's broadcasting license then it's no longer a licensee and so Ofcom cannot impose any sanction on them.

Ofcom can fine ITV, or any PSB, if it surrenders its licence(s) before they expire.

They probably wouldn't need to abandon the licences (nor in all likelihood would they want to - I doubt ITV want to loose the priveledge of having their 3/103 EPG position reserved for them) - they could probably convince OFCOM that such a move is vital for their survival and therefore should be allowed.

I know this story is completely manufactured out of a throwaway comment by a bank acting without really knowing what they are talking about, but considering that the ITC/OFCOM has a consistant track record of nothing but constantly re-writing their own rules to suit what ITV wants to do, it's not completely out of the question that they'd let them go pay TV but keep their PSB status and with it their EPG positions.

Considering ITV's portfolio, is there anything really unique or popular enough to support a pay-TV service?

Even paid catch-up for regular shows never really took off - why charge for what some pimply haX0r will put on youtube for you for free?
