I was reading through the complaints on the ITC web site (do people really have nothing better to do?) When I noticed that Channel TV are responsible for Bad Girls and the trailers for Pop Idol among others.
I thought Channel was a tiny outpost of ITV, who get a second hand feed from Merdian. I didn't realise they made or in the case of Bad Girls (which is made by Shed Productions) commisioned programes.
The ITV Network is the body which commissions programmes, not the regions. Check http://www.itv.com/channel - they might be able to confirm what you've just said, and maybe even disprove me.

Ah! Channel TV own a commercial production company called Creative Channel. They also do PowerPoint presentations, interactive games, and websites.

That's all completely irrelevant. Its all about complience. An ITV region needs to be responsible, that's why LWT are responsible for SM:TV even though they don't make it. Channel TV do a lot of cpmpliance for the various independant productions
Creative Channel were almost certainly responsible for the Pop Idol trailer then. I'm as confused as you about Bad Girls though. Just why are Channel the licensee who has to take the rap for it? It was made by a third party!
When a programme is made by an independent production company, such as Shed Productions, one of the ITV companies has to be responsible for it, and check that it is compliant with the rules. Channel tends to have responsibility for many productions on ITV because it makes very few of its own.
When the ITC upholds a complaint, it is the responsible ITV company which is fined, as the network as a whole cannot be fined, and neither can the independent company (I think).
Honestly, who on earth bothers to pick up the phone or put pen to paper to complain about a Pop Idol trailer showing an animated tortoise being blown up by Simon Cowell ?
