er, because they are the broadcaster and take ultimate responsibilty for what is said on their airwaves. lest we forget that it was only the publicity and 50,000 complainst which forced them to take action.

Endemol claimed nothing racist was said at all! Yet they told the Hm's they were being racist. Surely that's what they mean by "serious editorial misjudgements" Rolling Eyes

I don't think they blatently told housemates they were "being racist", they tried to play it cool by suggesting "Big Brother does not tolerate racial behaviour". I don't know, maybe whatever they said backfired and unfortunately why Ofcom saw it as poor editorial adjustments. They were trying to get an honest opinion from Shilpa and whether she thought it was racist or not.

From one of the pictures, it looks like they have changed the walkway and stairs direction. i.e. different to all other series.
