it used to be the case that showing Premier League games from foreign broadcasters was illegal because you were showing copyrighted material without authorisation - the copyrighted material in this instance not being the game coverage (it couldn't be considered an 'artistic creation', therefore was uncopyrightable), but instead the Premier League's intellectual property - ie the PL DOG that's on throughout the match on the world feed, and the music and replays, etc.

According to this article, there was a change to the law which covers all matches regardless. It claims that it made the picture clearer, the relevant amendment really is quite terse. This guidance note [pdf] explains it a bit more - it did indeed come about as a result of EU legislation, though as was mentioned upthread, that doesn't necessarily mean that it'll automatically be repealed as a result of Brexit.

The "Blackout" has nothing to do with Premier League revenues, but is an attempt to protect lower league revenues. It is largely a UK thing, very few other countries maintain one, Montenegro (not yet in the EU) being the only other country outside England, Scotland and Northern Ireland to have them.


I can't help but wonder if the best way to protect it might be to move almost all PL games to Sunday. There'd have to be exceptions for teams playing CL football on Tuesday - Friday night could work, but not if they have a Wednesday followed by a Tuesday in successive weeks (which can and does happen at present) so there'd probably still be one Saturday opening - but that would allow Saturday to hold its place for the Football League while the PL controls Sunday, in the same way that in the US the NFL plays on Sundays while Saturdays are for college games.
