Obtaining copyrighted materials from official sources

Let's suppose I want to insert a song titled "Speechless" (as heard in Disney's live action Aladdin film from this year) in a scene from Marvel Studios' Captain Marvel film, and want to ask The Walt Disney Company for a formal approval.

How do I proceed? Is there any kind of form do I have to fill in? And more obviously, how much do I have to pay?

(I know it would be much quicker to just pirate them. But they are the Disney, and this time, I want to learn how to formally obtain copyrighted materials for video editing.)

Why not try calling them up? Who knows.

Good luck! Disney is very protective of its content, and has very strict rules on how it can be used if they do decide to allow someone to use it. They're also very proactive about removing / stopping content which they haven't given permission for - be that videos on YouTube or people singing songs in a school play.

For these reasons they aren't part of the normal PRS/MCPS copyright clearance / royalties groups in the UK - you have to go direct to get permission.

I know we don't have "fair use" as such in the UK (though that's more common in the US) but we do have:

Fair dealing is an exception to United Kingdom copyright law which allows for the use of copyrighted works without licensing in certain circumstances. It is governed by two sections of the Copyright, Designs and Patents Act 1988 and is basically: Research, Criticism/Review or Current Event.

Presumably its safe to say your inserting Speechless into Captain Marvel isn't a current event (not in this reality anyway), its not a research project and you're not criticising or reviewing it (note: saying something is crap doesn't necessarily count as a 'review'). Meme usage used to be (relatively) fair game but Article 13 may have had some say in that.

As to budget - Charlie Brooker's Screenwipe did a skit about costs on TV scales, so you can multiply this up a while for films:

Glad to see some useful advices being provided here. Actually, I don't live in neither the United States nor the United Kingdom, so I may have to contact a local representative. (Although, I wonder if the USA fair use rules apply when I upload the clip on YouTube.)

Perhaps, I can say Jasmine breaking out of silence in this year's Aladdin film, and Captain Marvel setting herself free in the self-titled film, overlap each other with the feminist themes presented in recent Disney films, therefore providing criticism?
